The Firm is saddened to announce that our friend and colleague, Glenn R. Watson, died Sunday, December 26, 2010. He was 93.
The California appellate courts currently recognize a city’s local land use authority, pursuant to its police powers, to regulate and prohibit medical marijuana dispensaries. More recent case law, however, indicates limitations on that authority.
With the November 2, 2010 approval of Proposition 26, California’s local governments are left wondering how this latest limit on local fees will impact their operations.
The notion that a city or county can be liable for improper actions of its police or sheriff’s department under the federal civil rights statute, 42 U.S.C. Section 1983, is hardly novel.
Always a keen topic of judicial interest, public contracting and the public works bid process, again were the focus of California courts in 2010. We feature two cases of interest to public entities.
