Overview

In certain instances, a public agency and property owner are not able to reach a negotiated settlement in connection with the proposed acquisition of the property for a public use.  In such cases, the public agency has to consider the adoption of a resolution of necessity authorizing the filing of a complaint in eminent domain to proceed with the project.  RWG lawyers have significant experience in litigating condemnation actions.  We have successfully litigated on behalf of our clients a wide range of issues, including challenges to a public entity’s right to take property, issues relating to prejudgment possession of property, loss of business goodwill issues, larger parcel issues, severance damage issues, precondemnation damages issues, relocation assistance issues, and other more general valuation issues.
