Cannabis Deliveries Are Now Legal Throughout the State

Local ordinances that prohibit deliveries of cannabis products in cities may be impacted under new State regulations for cannabis businesses. These new regulations, approved January 16, 2019 by the Office of Administrative Law, take effect immediately.

Of particular interest to local agencies is a new regulation stating that “a delivery employee may deliver [cannabis] to any jurisdiction within the State of California provided that such delivery is conducted in compliance with all delivery provisions of this division.” 16 Cal. Code Regs. § 5416(d). It is anticipated that this regulation may be challenged, but for now, enforcement of an ordinance that conflicts with this regulation may subject a local jurisdiction to litigation.
